1. These terms and conditions

1.1 Why you must read them:

Please read these terms and conditions carefully. They set out the obligations (the 'terms') between you and Advice NI ('Advice NI', 'we', 'us', or 'our'). The terms explain what happens once you have placed an order, how to make payment, how you and we may change or end the contract, what to do if there is a problem and other important information.

1.2 Future reference:

You should retain a copy of these terms for future reference.

1.3 What these terms cover:

These terms cover the provision of the events that we organise, and which are available through our training (the 'event') programme.

1.4 Who we are:

We are a Charity limited by guarantee. Our offices are located at Advice NI, Forestview, Purdy’s Lane, Newtownbreda, Belfast, BT8 7AR.

1.5 How to contact us:

(a) Event Queries - For any queries related to the event, please contact our Training Department at training@adviceni.net or on 028 90 645 919. For Wiseradviser NI events, please contact wiseradviser@adviceni.net or on 028 90 645 919.

(b)  Finance Queries - For queries related to payment or invoicing of the event, please contact our Finance Team at finance@adviceni.net or on 028 90 645 919.

2. Our contract with you - How we will accept your booking

2.1. Booking Description:

Any description, advertisement, documentation issued by us and any description contained on the Advice NI website or any promotional materials relating to the event are issued and published for the sole purpose of giving you a general idea of the event, its content and objectives. Subject to any obvious error, the description and price of the event will be as quoted on the website at the date your booking is made. All payments under these terms shall be in UK pounds sterling.

To ensure that the event you book is the right one for you please read the course details carefully. If you are unsure if an event is suitable to your training needs, please contact us prior to booking, at the details provided in Clause 1.5.

2.2. Booking Process:

Our Website (LMS) guides you through the booking process from the course booking link. All details can be reviewed before completing the booking process, so please take time to read and check the emails at each stage. Please ensure the e-mail address you provide at the time of booking is the email address you wish the confirmation email to be sent to. For Wiseradviser NI courses, you must book through your Wiseradviser NI account.

2.3. Booking Confirmation: 

Upon submitting an online booking for a place on an event, you will be given confirmation of our acceptance of your order (a 'booking confirmation') and course instructions which includes important details of the training event. These will be sent in two separate emails. Where an event is full, you will be directed to the ‘Waiting List’ rather than the booking process and you will be contacted via email if a place becomes available where you will then be prompted to place a booking. All bookings are subject to availability, and we have the right to decline a booking.

2.4 Booking Contract:

A booking confirmation or attendance at the event brings into existence a legally binding contract based on these terms between you and us.

3. Price and payment

3.1.  Payment Options:

You must purchase the event(s) by paying the appropriate fees as set out on the website. At the time of booking, you can request to make payment in the following ways:

(a) immediately online by credit or debit card.

(b) by requesting an invoice and making the payment via BACS (or another method agreed with our Finance Team). The invoicing option is available to organisations only. For bookings placed by private individuals, payment is due at the time of booking.

3.2 Invoice Address:

Where an invoice is requested, the invoice for payment of the appropriate fees shall be sent to the organisation contact address (email) you provide at the time of booking. It is your responsibility to ensure;

(a) The payment contact/address provided is correct;

(b) You have authority from the organisation for payment

(c) That the payment terms are met.

3.3 Invoice Payment:

You are required to ensure that any invoice is paid within 28 days of the date on the invoice.

3.4 Pre-Payment Attendance:

Attendance at the event before we receive payment will form a legally binding contract in accordance with clause 2.4.

3.5 Non-payment:

Where you do not pay the appropriate fees in accordance with this Clause 3 or Clause 6.7, this will constitute a breach of this contract and;

(a) we may refuse you entry to the event;

(b) we may take legal action in order to recover any outstanding fees;

(c) we may refuse or cancel future bookings where payments for an event under these terms remain outstanding (this will include upcoming free events).

3.6. Free Events:

For Free events you will not be charged or invoiced for the event, unless cancelled outside of our cancellation period in accordance with Clause 6.1 and 6.2, or subject to no-show/transfer fees (Clause 6.7).

4. Our rights to make changes

4.1 Changes to the event:

We reserve the right to change venues (within the same county), substitute trainers and consultants, and formats (e.g. f2f to virtual) at our discretion.

5. About the event(s)

5.1.  Face to face training

The event(s) shall take place on the date and at the venue set out in the booking confirmation unless otherwise changed in accordance with Clause 4.1. We shall take all reasonable care to deliver the event and comply with the information you have been provided with.

5.2 Digital training

In advance of digital training (virtual/online), both parties will make best endeavours to ensure that the agreed platform is accessible and capable of delivering/receiving the service to an acceptable standard.

5.3 Digital Faults/Failures

Neither party shall be liable for fault or failure of the agreed platform that may occur immediately prior to or during the delivery of the service, should it be deemed outside of their control.

5.4 Copyright:

Any materials provided by Advice NI for or during our events are protected under copyright law and remain the intellectual property of Advice NI. These materials may not be reproduced, shared, or used without the express written permission of Advice NI.

6. Cancellation, Transfer or Postponement:

6.1 Cancellation Period:

You have the right to cancel within 5 working days before the date of the event (the 'cancellation period') and a refund will be made in accordance with Clause 6.6. Outside of the cancellation period (less than 5 working days prior to the event), you will lose your right to cancel your booking on the event and will incur a fee in accordance with Clause 6.7.   

6.2 Cancelation Request:

a. Advice NI Training Events:

You may only cancel your event booking in writing, by email, to Advice NI’s Training Department using the details provided in clause 1.6 (training@adviceni.net). When contacting us, please provide your name, address, details of the order, phone number and email address.

b. Wiseradviser NI Training Events:

For Wiseradviser NI courses you must cancel your course place online through your Wiseradviser NI account, when inside the cancellation period (Clause 6.1). However, when outside the cancellation period, you may only do so in writing by email, to Advice NI’s Training Department using the details provided in clause 1.6 (wiseradviser@adviceni.net).  When contacting us by email, please provide your name, address, details of the order, phone number and email address.

6.3 Transfer Period/Conditions*:

If you are unable to attend the event due to unforeseen circumstances (e.g. sickness) and are outside of the cancelation period, and have not cancelled your place within 3 working days before the event, you have the right to transfer your place to a substitute delegate in the following circumstances:

(a) There is no formal application process or placement requirement for the event;

(b) The transfer request is made to and agreed by Advice NI within 3 working days before the event;

(c) Advice NI agrees that the new delegate meets the pre-entry requirements required for the event;

(d) The required detail changes (new delegate name, email, phone number, and payment agreement) are provided to Advice NI (following approval of the transfer request) within 3 working days before the event in accordance with Clause 6.4.

(e) The substitute delegate confirms agreement to the terms and conditions including payment.

(f) For accredited or endorsed courses where the original delegate has been registered with an Awarding Body, the additional Awarding Body fees for the substitute delegate are paid in accordance with Clause 6.7.

*Important: Please note that Clause 6.3 does not apply to any Wiseradviser NI events. Wiseradviser NI course places cannot be transferred to another delegate under any circumstances.

6.4 Transfer Request:

You may only request transfer of an event place in writing, by email, to the Training Department using the details provided in clause 1.6 (training@adviceni.net). When contacting us, please make sure the transfer conditions are met and your name, address, details of the order, phone number, email address, are provided, alongside that of the new delegate as per Clause 6.3(d).

6.5 Your rights if we cancel an event:

(a) Wherever possible, we will contact you in advance to tell you we will be cancelling an event, unless an emergency requires us to cancel the event on the day.

(b) We reserve the right to cancel or postpone events if there are insufficient delegate numbers to ensure a high-quality training experience or if a trainer becomes unavailable.

(c) In the event that we cancel or postpone an event, we will offer you a place on the next available event. Alternatively, you may ask for a refund which shall be made in accordance with Clause 6.6.

6.6 How we will refund you:

(a) Where an event is cancelled in accordance with Clause 6.1, 6.2, or 6.5, where pre-paid and not transferred, you shall be entitled to a refund of the fees for that event.

(b) Where an event is cancelled pursuant to Clause 6.5 we will refund your fees (where pre-paid) for the event but not any other expenses (for example; hotel or rail fares).

6.7 Cancelation, Non-Attendance & Transfer Fees:

(a) Places cancelled outside our cancellation period (Clause 6.1) or not in line with our cancellation request process (Clause 6.2) will be subject to a cancellation fee. This includes no-shows (non-attendance) fees. The fee will be charged at:

(i) £30 for Free events or events under £85.

(ii) 50% of the full fee for events £85 or above.

(b) Places transferred to another delegate in accordance with clause 6.3 & 6.4, where no Awarding Body registration has taken place will not incur a fee. Transfers outside of this are not possible.

(c) For accredited or endorsed courses, where the original delegate has been registered with an Awarding body prior to transfer of place, the original delegate and substitute delegate Awarding Body fees will be charged (at the awarding body fee) and must be paid in line with payment terms and conditions (Clause 3.1-3.5).
